Memo Tariff Rules
Rule No 1: Applicability of Tariff
1. General
This tariff, including all rules, regulations and charges published herein, will apply to the carriage of cargo, including all services incidental thereto, performed by or on behalf of Amerijet International, Inc.
2. Change without Notice
This tariff and the rates and charges published herein are subject to change without notice, except to the extent otherwise provided by applicable law or government regulations or order; provided, however, that no such change shall apply to a contract of carriage after the date of issuance of the Air Waybill by Carrier.
3. Effective Rules
All carriage of cargo governed by this tariff shall be subject to Carrier’s rules, regulations and tariffs in effect on the date of receipt of the shipment by Carrier.
4. Gratuitous Carriage
With respect to gratuitous carriage, the Carrier may exclude the application of all or any part of this tariff.
Rule No. 2: Definitions
Actual Cash Value
Means the replacement cost less depreciation of a particular cargo.
Advance Arrangement
Means the Shipper must contact the Carrier or Carriers’ local representative, prior to tender departure of the shipment.
Area No.1
Means all of the North and South American Continents, Greenland, Bermuda, Cuba, Haiti, Dominican Republic, Puerto Rico, Jamaica, Netherlands Antilles, Trinidad, Bahamas, Leeward and Windward Islands, the State of Hawaii, Midway Island, Palmyra Island, Central America, Mexico, Panama, Turks & Caicos Islands, and Cayman Islands.
Airport
Means a landing area used regularly by aircraft for receiving or discharging cargo and premises adjacent thereto, which is designated by the Carrier for acceptance, delivery and customs clearance of shipments.
Airbill / Air Waybill
Means the document made out by or on behalf of the Shipper which evidences the contract between the Shipper and Carrier for carriage of cargo over routes of the Carrier.
Articles Of Extraordinary Value
Means art works; bills of exchange; bonds; bullion or precious metals; currency; deeds; dore bullion; evidences of debt; furs; gems (cut or uncut); gold bullion, coined, uncoined, cyanides, dust or sullides; jewelry (other than costume jewelry); money; promissory notes; pearls; platinum; securities negotiable; silver bullion, coined, uncoined concentrates, cyanides precipitates or sullides; stamps; postage or revenue; stock certificates; or any other individual item with a declared value, invoice value, or appraised value in excess of US$25,000.00.
Bill Of Lading (Bol Or B/L)
Means the written transportation contract between the Shipper and the Carrier (or their agents). It identifies the freight, who is to receive it, and place of delivery; and gives the terms of the agreement.
Cargo
Which is equivalent to the term goods means anything carried in an aircraft or to be carried in an aircraft, other than mail or baggage; provided that unaccompanied baggage moving under an Air Waybill is cargo.
Carriage
Which is equivalent to transportation means carriage of a shipment by air. See also, Carrier.
International Carriage
Means (except when the Warsaw Convention/ Hague Protocol/Montreal Protocol No. 4/Montreal Convention is applicable) carriage in which according to the contract of carriage, the place of departure and any place of landing are situated in more than one State. As used in this definition, the term “Country” includes all territory subject to any sovereignty, suzerainty, mandate, authority, or trusteeship thereof. International carriage as defined by the Warsaw Convention/Hague Protocol/Montreal Protocol No.4/Montreal Convention means any carriage in which according to the contract of carriage, the place of departure and the place of destination, whether or not there be a break in the carriage or trans-shipment, are situated either within the territories of a High Contracting Party, or authority of another Country, even though that State is not a party to the Convention.
Domestic Carriage
Means, (except as otherwise specified) carriage in which according to the contract of carriage, the place of departure, the place of destination and the entire transportation are within one Country.
Carrier
Includes the air Carrier issuing the Air Waybill and all Carriers that carry or undertake to carry the cargo under such Air Waybill or perform any other services related to such air carriage.
CCA
Means Cargo Correction Advice.
Charges Collect
Means the charges entered on the Air Waybill for collection from the consignee.
C.O.D.
Means Collect on Delivery.
Consignee
Means the party whose name appears on the Air Waybill as the party to whom the shipment is to be delivered by the Carrier.
Consignment
Means the same as Shipment.
Consignor
See Shipper.
Continental United States Or Continental U.S.A.
Means the District of Columbia and all contiguous States of America.
Convention
Means, unless the context requires otherwise, the Convention for the Unification of Certain Rules relating to International Carriage by Air, signed at Warsaw, October 12, 1929, or that Convention as amended by the Hague Protocol, 1955, Montreal Protocol No. 4, Montreal Convention, whichever may be applicable to carriage hereunder.
Customs Consignee
Which is equivalent to the term Customs Clearance Agent, means a Customs Broker or other agent of the consignee designated to perform clearance services for the consignee.
Dangerous Goods
See Hazardous Materials.
Days
Means full calendar days, including Sundays and legal holidays; provided that, for purposes of notification, the balance of the day upon which the Air Waybill is issued or flight commenced shall not be counted.
Delivery Service
Means the surface carriage of inbound consignments from the airport of destination to the address of the consignee or that of their designated agent, or to the custody of the appropriate government agency when required.
Demurrage
Means detention of an airplane, truck, or ULD (unit load device) due to a delay beyond the time allowed to load or unload its cargo; and the charge for such a delay. See Unit Load Device.
Domestic Rate
Means a rate(s) applying between two points within one country.
Door To Door
Means a shipment of cargo that Amerijet picks up and accepts at the premises of a Shipper or his representative, transports to the departure airport, and delivers from the destination airport to the premises of the consignee or his representative.
Full Container Load
(FCL)
Means an entire cargo container devoted exclusively to one Shipper’s cargo. See Less-than-container-load.
Exp
Refers to Amerijet’s Express product. It guarantees movement on the next available flight, EXP shipments move at the highest priority.
General Cargo
Means any consignment except a consignment containing articles of extraordinary value, or valuable cargo as defined herein.
Gold Bullion
Means refined or unrefined gold in ingot form, dore bullion, gold specie, and semi manufactured products of gold (including only grain, sheet, foil, powder, sponge, wire, rod, tube, circles and castings).
Goods
See definition for Cargo.
Hazardous Materials
Means articles named in Hazardous Material Regulations CFR 49, issued by the U.S. Department of Transportation, or as defined by IATA.
Also called Dangerous Goods.
In-Bond
Means storage of merchandise in a bonded terminal or warehouse to await Customs clearance for entry into the country where the terminal or warehouse is located, or transshipment to another country.
Insurance
Means promise of reimbursement in the case of loss; paid to people or companies so concerned about hazards that they have made prepayments to an insurance company.
Subrogated Claims
Means if the Shipper or consignee insures the cargo, the insurer who indemnifies him under the terms of the insurance coverage may, as a matter of law, be entitled to seek recovery of the amount paid to this insured form the party who is liable for the loss to the cargo. This is referred to as a subrogated claim.
Interline
Means the carriage over the routes of two or more Carriers.
Issuing Carrier
Means the Carrier who issues an Air Waybill or Bill of Lading.
Joint Traffic
Means freight moving from origin to destination via two or more Carriers.
Legal Holidays
Means Local, State or National holiday.
Less Than Container Load (LCL)
Means less than an entire cargo container devoted to one Shipper’s cargo.
Live Animals
Shall mean all mammals/primates (other than humans), domesticated or wild, not restricted for import/export by any government regulation or law.
Local Rate
Means a rate that applies to transportation over the lines or routes of one Carrier only.
Master Air Waybill
(MAWB)
Means an Air Waybill that shows a consolidator as Shipper of a consolidated shipment.
Minimum Charge (MC)
The minimum amount which applies for the transportation of air cargo service, no matter how small the shipment.
Perishable Shipments
Means those shipments that are subject to possible decay and/or due to change in the climate, temperature, altitude or other ordinary exposure, or because of length of time in transit, or inherent vice while in Carrier’s possession, for more information please refer Rule 110.
Personal Effects
Mean personal effects consisting of wearing apparel, cosmetics, and toilet articles worn or used by an individual, not for resale.
Pickup And Delivery (P & D or PU & D)
Means local movement of freight between the Shipper’s pickup point and the originating terminal, or between the destination terminal and the consignee.
Pivot Weight
Means (for container rates) the weight at which an additional charge is incurred for each additional pound, or (for bulk rates) the actual weight at which the charge in a lower weight break exceeds the minimum rate for the next higher weight break.
Position
Means the space a unit load device occupies on a cargo aircraft.
Platinum
Mean platinum, platinum metals (palladium, iridium, ruthenium, osmium and rhodium), and platinum alloys in un-manufactured form, i.e. grain, bar, sponge, ingot, sheet, rod, wire, tube or strip.
Pallet
Means a platform or skid on which cargo sits, facilitating its movement with a forklift. See Unit Load Device (ULD).
SDR
Refers to the value of a national currency equivalent to the regime’s Special Drawing Rights per kilogram.
Shipment
Except as otherwise provided herein, means one or more packages, pieces or bundles accepted by the Carrier from one Shipper at one time and at one address, receipted for in one lot and moving on one Air Waybill to one consignee at one address.
Shipper
Which is equivalent to Consignor, means the person whose name appears on the Air Waybill as the party contracting with Carrier for the carriage of the shipment. “United States Of America” or “The United States” or “The U.S.A.” or “U.S.” or “US” each means the area comprising the 49 contiguous federated states; The Federal District of Columbia; Alaska; the Hawaiian Islands; Puerto Rico; the Virgin Islands; American Samoa; Canton, Guam, Midway and Wake Islands.
Small-package Express (SPX)
Means Amerijet’s expedited service for shipments of up to 90 kilograms (kg), with the highest boarding priority, the fastest transit time, and special attention throughout their journey.
Small-Package Service (SPS)
Means Amerijet’s standard service for shipments of up to 90 kilograms (kg).
Transfer Manifest
Means the document issued when a Carrier transfers interline cargo and endorsed by the Carrier receiving the cargo.
U.S Package Service
Means an Amerijet service providing personal U.S. post-office box mailing addresses to international customers to give to vendors who require a U.S. mailing address. This service enables customers anywhere in the world to receive shipments from their favorite U.S. catalogs and websites.
Valuable Cargo
Means any shipment which contains one or more of the following:
Any article having a declared value for carriage of $450.00 or more, per pound. Gold bullion (including refined and unrefined gold in ingot form), dore bullion, gold specie and gold only in the form of grain, sheet, foil, powder, sponge, wire, rod, tube, circles, moldings or castings: platinum; platinum metals (palladium, iridium, ruthenium, osmium and rhodium) and platinum alloys in the form of grain, sponge, bar, ingot, sheet, rod, wire, gauze, tube or strip (but excluding radioactive isotopes of the above metals and alloys which are subject to Hazardous Material Regulations, CFR 49, issued by the U.S. Department of Transportation).
Legal banknotes, traveler’s checks; securities; shares; share coupons and stamps (excluding mint).
Diamonds (including diamonds for industrial use), rubies, emeralds, sapphires, opals, real pearls and cultured pearls.
Jewelry consisting of diamonds, rubies, emeralds, sapphires, opals, real pearls and cultured pearls.
Credit cards – blank, unissued.

Rule No. 5: Execution Of The Non-negotiable Air Waybill
Execution: The Shipper or authorized agent of the Shipper shall make out, or have made out on his behalf, an Air Waybill for each shipment presented and shall deliver such Air Waybill to Carrier at the time and place Carrier accepts cargo for carriage.
Apparent Order And Condition Of Cargo: If the apparent order and condition of the cargo and/or packing is other than good, the Shipper shall insert in the Air Waybill the apparent order and condition of the cargo and/or packing. However, if the Shipper fails to do so, or if such statement is inaccurate, Carrier shall insert in the Air Waybill a statement of the apparent order and condition or note a correction thereon.
Preparation, Completion Or Correction By Carrier: Carrier will at the request of the Shipper, make out the Air Waybill, in which event, subject to proof to the contrary, Carrier shall be deemed to have done so on behalf of the Shipper. If the Air Waybill handed over with the cargo does not contain all the required particulars, or if it contains any error, Carrier is authorized to complete or correct it to the best of Carrier’s ability without being under any obligation to do so.
Responsibility For Particulars: The Shipper is responsible to Carrier and all other persons for the correctness of the particulars and completeness of the particulars and statements which he inserts in the Air Waybill, or which Carrier inserts on his behalf. The Shipper shall be liable for all damages suffered by Carrier or any other person by reason of the irregularity, incorrectness or incompleteness of said particulars or statements, whether the Air Waybill was made out by or on behalf of the Shipper by Carrier (or completed by Carrier) on behalf of the Shipper pursuant to Paragraph C above.
Alterations: Air Waybills, on which the writing has been altered or erased, need not be accepted by Carrier.
Contents Of Shipment: The contents of shipments must be indicated by accurate and complete descriptions on the Air Waybill. The total number of pieces included in a shipment must be specified on the Air Waybill.
Change To Payment Of Charges: The charges for transportation may be changed from collect charges to prepaid charges, or from prepaid charges to collect charges, only upon written request of the Shipper to the Carrier prior to delivery of the consignment to the Consignee or his agent.

Rule No. 16: Payment Of Charges
EXCEPTION: When the Consignee does not receive any part of a shipment, a claim with respect to such shipment will be entertained even though transportation charges are unpaid.

The value of a national currency equivalent to the regime’s Special Drawing Rights per kilogram is calculated in accordance with the method of valuation applied by the International Monetary Fund, in effect at the date of the judgment.
Rule No 18: Oversized Shipments
Below subject to the rates and charges shown in paragraph B of this rule.
Unusual shipments do not apply to this rule. Refer to Rule No. 50, paragraph 6.
Rule No. 25: Acceptability Of High Value Shipments For Carriage
No consignment having a declared value in excess of $25,000 will be accepted for carriage unless special arrangements therefore have been made in advance with the Carrier.
Rule No. 35: Valuation Limits For One Aircraft
In instances where the aggregate value of the consignments or group of consignments to be transported in one aircraft exceeds $300,000, it is the sole option of the Carrier to decide whether to accept or refuse to transport such consignment.
Rule No. 40: Shipments Acceptable
Carrier undertakes to transport, subject to space and availability of suitable equipment, all shipments unless otherwise excluded by Carrier’s tariffs and provided that:
It will be the Shipper’s sole responsibility for any non-compliance with the conditions set for in the Rule relating to or causing any damage, delay, or less of whatsoever nature of the cargo; and the Shipper agrees to indemnify the Carrier for any liability or responsibility for any such damage, delay, loss of whatsoever nature, and penalties the Carrier may incur due to the carriage of such cargo.
Rule No. 45: Packing And Marking Of Shipments
Rule No. 50: Shipments Acceptable Only Under Prescribed Conditions
Shipments described in this rule will only be accepted for carriage subject to the following conditions:
A. Animals Live (AVI)
Live animals or certain types which are not restricted by any government regulation or law and are of a size adaptable to carriage, will be transported, provided advance arrangements have been made with the Carrier. The Carrier will not be responsible for mortality due to natural causes. Such animals will be transported provided that:
The following will be accepted by the Carrier only under the conditions:
B. Human Remains (HUM)
Uncremated human remains, cremated human remains, tissue samples, blood or body parts for scientific research will be carried by Carrier provided that advance arrangements have been made with the Carrier. Cremated human remains, tissue samples, blood will be transported without advance arrangements. Uncremated human remains and body parts for scientific research will be accepted for carriage only when they are secured in the casket to prevent shifting, are placed in hermetically sealed caskets, enclosed in outside containers, or in hermetically sealed metal cases, and are accompanied by a certificate of death. All laws, ordinances or other governmental rules or regulations governing the transportation of human remains must have been complied with by the Shipper and/or Consignee.
C. Firearms
Sporting firearms, namely; pistols, shotguns, rifles and trapline guns; may be accepted for carriage between points in the United States, subject to advance notification to Carrier. NOTE: Shipment of these and other firearms may at times be accepted for carriage to certain destinations, subject to Shipper’s application direct to the Carrier, and Carrier’s confirmation that the specific shipment, routing and destination will be permissible. Carrier will not transport consignments of firearms unless all bullets, shells and cartridges are removed.
D. Perishables (PER)
Shipments of perishables which are liable to deteriorate or perish due to changes in climate, temperature, altitude or other ordinary exposure, or because of length of time in transit, will be accepted without responsibility on the part of Carrier for loss or damage due to such deterioration or perishability subject to Rule No. 110 paragraph H and the following:
E. Charges Collect Shipment Requirements
Shipments will be accepted by Carrier with charges either prepaid or to be collected at destination, except that Carrier may decline to transport the following on a charges collect basis.

Unusual shipments are:
Unusual shipments will not be accepted for transportation unless advance arrangements have previously been made. Shipments requiring special devices for safe handling will be accepted only when such special devices are provided and operated by and at the risk of the consignor and/or Consignee.
G. Hazardous Materials:
Hazardous materials are acceptable for carriage only under the conditions set forth and permitted by and in accordance with the U.S. Code of Federal Regulations, Part 49, 171-177, issued by the U.S. Department of Transportation, or IATA Regulations whichever is most comprehensive at the time and date of shipment.
NOTE:
A number of acids, chemicals, plastic products and similar materials, although acceptable for carriage because of their content, are consigned under trade or technical names similar to names and items prohibited for carriage. Documents covering such consignments, including Air Waybill, must contain a description of the chemical contents of the article(s) consigned. Such shipments which meet the requirements as states herein, will be accepted for carriage provided that the Shipper:

Notwithstanding any other provisions or Rules set forth in this Tariff, the following cargo will not be accepted by the Carrier for carriage:
Rule No. 60: Responsability For Non-observance Related To Restricted
Responsibility for the non-observance of the conditions relating to cargo which is not acceptable for carriage or is acceptable only under certain conditions, rests upon the shipper and the owner of the cargo, who jointly and severally agree to indemnify Carrier for any loss, damage, delay, liability or penalties it may incur from carriage.
Rule No. 65: Carrier’s Right To Inspections
At the sole option of the Carrier, the Carrier may inspect the contents of all consignments, but the Carrier shall not be obligated under any circumstances to perform any inspection of any consignment. All Shippers are required to certify that the shipment or consignment does not contain any unauthorized explosives, destructive devices or hazardous material. All Shippers are required to present two forms of identification as required by government regulations.

Disbursements And Customs Formalities:
Carrier will, but shall be under no obligation to advance any duties, taxes or charges and to make any disbursements with respect to the cargo, and the Shipper, owner and Consignee shall be jointly and severally liable for the reimbursement thereof. Carrier shall not be under obligation to incur any expense or to make any advance in connection with the forwarding or re-forwarding of the cargo except against prepayment by the Shipper. If it is necessary to make customs entry of the cargo at any place, the cargo shall be considered to be consigned at such place to the person named on the face of the Air Waybill as customs Consignee or, if no such person be named, to the Carrier carrying the cargo to such place or to such customs Consignee,
if any, as such Carrier may designate. For any such purpose a copy of the Air Waybill, certified by Carrier, shall be considered an original.

Schedules, Routings, And Cancellation
Carrier reserves the right without notice, to cancel, terminate, divert, postpone, delay or advance or further carriage of any cargo, or to proceed with any flight without all or any part of the cargo, if it considers that it would be advisable to do so because of any fact beyond its control or not reasonably to be foreseen, anticipated, or predicted at the same time the cargo was accepted; or if it considers that any other circumstance so require. Paragraph B of this rule
Rule 95 herein, notice of arrival of the consignment will in the absence of other instructions be given to the consignee or the party to be notified, such notice will be given by ordinary methods. Carrier is not liable for non-receipt or delay in receipt of such notice.
Rule No. 95: Forwarding And Re-forwarding
Consignments are accepted for carriage from their receipt at Carrier’s Cargo Terminal or designated facility at the place of departure to the airport at the place of destination or for re-forwarding beyond the airport to destination. If such forwarding or re-forwarding is by carriage operated by Carrier, such carriage shall be upon the same terms as to liability as set forth in Paragraph (A) & (B) of Rule 70 hereof. In any other event, the issuing Carrier and last Carrier, respectively, in forwarding and re-forwarding the consignments, shall do so only as agents of the Shipper, owner, or Consignee, as the case may be and shall not be liable for any damage arising out of such additional carriage unless proved to have been caused by its own negligence or willful fault. Carrier will do all things advisable to effect such forwarding or re-forwarding, including but without limitation, selection of means of forwarding or re-forwarding and the routes thereof (unless these have been specified by the Shipper in the Air Waybill), execution and acceptance of document of carriage (which may include provisions exempting from or limiting liability) and consigning of consignments with no declaration of value, notwithstanding any declaration of value in the Air Waybill.
Rule No. 100: Successive Carriers
Carriage to be performed under one Air Waybill by several successive carriers is regarded as a single operation.

Rule No. 115: Claims/actions – Procedures And Time Limitations
Definition of a cargo claim: A cargo claim is a written complaint demanding financial restitution from an air Carrier for the loss of or damage or delay to cargo whilst in the care, custody and control under a contract of carriage.
If the claim involves non-convention international carriage, reference should be made to the law applicable to the contract of carriage and terms of the Air Waybill to identify who should send the written notice.
The notice of claim must be sent to the Carrier. Certain legal systems consider that notice to the Carrier’s handling agent does not constitute valid notice for the purpose of the Conventions and therefore it is recommended that wherever possible, notice should only be sent to the Carrier.
Note: No claim for loss or damage to a shipment will be entertained until all transportation charges thereon have been paid in full. The amount of the claim may not be deducted from transportation charges; for more information see Rule 16. Any right to damages against the Carrier shall be extinguished unless the applicable provisions of this rule have been complied with by the claimant and unless an action is brought within two (2) years after the occurrence of the events given arise to the claim.
Rule No.125: Modification And Waiver
No agent, servant or representative of Carrier has authority to alter, modify or waive any provisions of the contract of carriage or of this tariff without the execution of a CCA.

Rates apply only General dry cargo, which are self-contained, non-hazardous, or non-temperature sensitive. Rates apply based on the execution/acceptance date. All shipments are subject to Amerijet’s handling and pricing terms and conditions as published in Amerijet’s Memorandum Tariff located at www.amerijet.com. All freight charges are based on chargeable weight (greater between actual/gross and dimensional/volume weight). Rates are subject to change without notice. IATA Unit Load Devices (ULD)
